General Terms and Conditions of Sale
The customer explicitly waives their own general terms and conditions, even if these are drafted after these general terms and conditions of sale. Deviations are only valid if they have been expressly agreed upon in writing in advance.
Our invoices are payable within 15 working days, unless a different payment term is stated on the invoice or order form. In case of non-payment on the due date, Pierre & Jules BV reserves the right to charge a flat interest of 10% on the outstanding amount. In the event of late payment, Pierre & Jules BV is entitled to suspend further services without prior notice.
If a payment remains outstanding for more than sixty (60) days after the due date, Pierre & Jules BV reserves the right to engage a collection agency. All judicial and extrajudicial costs are at the customer’s expense.
In some countries, a withholding tax is applied to the invoice amount, in accordance with local legislation. Any such withholding tax is at the customer’s expense and must be directly paid to the tax authorities of that country. Pierre & Jules BV is in no way responsible for costs arising from the legislation of the country in which the customer is established. The full invoice amount remains due to Pierre & Jules BV, without any deduction or offsetting.
Pierre & Jules BV commits to delivering on time and with quality to the best of its ability, in accordance with agreed timelines. However, none of Pierre & Jules BV’s obligations can be regarded as an obligation to achieve results. Equipona can under no circumstances be required by the customer to intervene as a third party in damage claims filed by an end user against the customer.
Any complaint must, to be admissible, be addressed by registered letter to the headquarters of Pierre & Jules BV within 8 days after delivery of the goods or services.
